A: While Florida Medical Malpractice statutes require a physician expert to attest to the merit of a case before it is filed, there is much more that goes into the overall preparation of the case once it is filed.  A CLNC can provide a very thorough chronological timeline or other type of report that can be used by the entire legal team to keep details, events and key players organized.  The CLNC can provide additional services at a more cost effective rate than a physician expert, such as researching standards, analyzing and summarizing depositions and testimony, identifying potential tampering of records and finding experts who can testify.  While many law firms rely on paralegals that do not have a healthcare background to perform many of these services, a registered nurse knows the inner workings of the healthcare environment and can complement the legal team, making everyone more effective in their respective role.

Q: Why can't the physician expert handle all the healthcare aspects?

A: There is a significant difference between the hourly rate for a physician and the Certified Legal Nurse Consultant.  By using the CLNC for most of the detailed work, and the physician expert for necessary expert opinion on causation and damages, the attorney increases the profitability for that case.  Nurses are far more detail oriented in producing a work product that is effective for case presentation, and can better speak to the nursing issues of a case.  The CLNC's at Anderson Medical Legal Consulting will work with the attorney to stay within the budget of the case and remain in close communication with the attorney when it appears the budget may not be adequate.

A: The Certified Legal Nurse Consultant understands the inner workings of healthcare, and often, a legal case can be won or lost based on what is NOT in the medical record that SHOULD have been documented.  A nurse has been taught to read and interpret documentation made by every member of the healthcare team, including physicians, other nurses, and other healthcare professionals.  And he/she is one of the best at identifying potential tampering in the record.

A: A Certified Legal Nurse Consultant has access to a very large nationwide network covering every range of healthcare specialty.  In addition, by allowing the CLNC to first screen the case, he or she can more effectively identify and recommend the best type of expert for that case, AND can assist by acting as the liaison between the expert and the law firm regarding key dates and next steps.  The CLNC can also summarize expert testimony and reports to assure there are no inaccuracies.

A: The CLNC can help attorneys tap into the most authoritative medical literature and other resources available on the topic.  A standard search will not lead you to all relevant standards of care.  A CLNC can help to weed out the irrelevant sources and can provide an assessment of the opposing side's sources.
